DEFINITIONS

In these regulations, the following terms written in capital letters should be understood:

"PHZ Baltona" - Przedsiębiorstwo Handlu Zagranicznego Baltona S.A. with its registered office in Warsaw at ul. Workers' Defense Committee 49, 02-146 Warsaw, registered in the register of entrepreneurs of the National Court Register in the District Court for the capital city of Warsaw, XIVth Commercial Division of the National Court Register under number 0000051757, NIP: 5860102292, REGON: 000144035, share capital of PLN 350 207 395.50, paid in full, e-mail: biuro@baltona.pl. The registered office address is also the address for contact and filing complaints.

"Regulations" – these regulations, which in the scope of electronic services are the regulations referred to in art. 8 of the Act of 18 July 2002 on the provision of services by electronic means.

"Consumer" – a person defined in the provision of art. 22¹ of the Civil Code.

"Entrepreneur with consumer rights" - a natural person concluding an agreement with PHZ Baltona within the Service directly related to their business activity, when the content of this agreement indicates that it does not have a professional character for them, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

"Service" - the PHZ Baltona internet portal, the home page of which is located at www.crewshop.pl

"User" - a natural person with full legal capacity, a legal person or an organizational unit without legal personality, acting through duly authorized persons, who has registered and uses the services provided electronically on the Service.

"Account" - User account established by him on the Website in accordance with the principles set out in the Regulations,

"Website Partner" – entities with which PHZ Baltona has concluded an agreement to provide access to the Website for employees or associates of a given entity.

1. GENERAL PROVISIONS AND SCOPE OF APPLICATION

1.1 PHZ Baltona provides free services electronically via the Website to Users consisting of: creating and maintaining an Account, concluding agreements for the sale of goods via the Website and concluding agreements for the provision of paid services via the Website. Additionally, the Website also offers the possibility of subscribing to the Newsletter. The prices given on the Website are gross prices including applicable taxes, including in particular the goods and services tax (VAT) at the rate specified by the currently applicable provisions of law. The provisions regarding the sale of goods shall apply accordingly to paid services provided by PHZ Baltona, unless otherwise provided in the Regulations.

1.2 By registering, the User concludes an agreement with PHZ Baltona for the provision of free services by electronic means, for an indefinite period, which may be terminated at any time under the terms specified in the Regulations. By purchasing goods available on the Website, the User concludes a sales agreement for the selected goods with PHZ Baltona with the obligation to pay the price, from which the Consumer and the Entrepreneur with consumer rights may withdraw in accordance with applicable law.

1.3 PHZ Baltona is obliged to deliver the purchased goods to the User within the deadlines specified in the order.

1.4 By the specified working days, it should be understood as all days of the week, except for Saturdays, Sundays and public holidays in Poland.

1.5 PHZ Baltona points out that the prices of goods on the Website are reduced in relation to the prices of the same goods available in PHZ Baltona stationary stores. For this reason, the price of the goods in the stationary store is presented as the starting price on the Website, which is crossed out and next to it is the price of the goods on the Website. The discount percentage may also be presented next to the price.

1.6 Regardless of the above, the Service may conduct various promotional campaigns.

2. CREATING AN ACCOUNT ON THE SERVICE

2.1 The ability to purchase goods is available on the Service only for Users who meet the condition specified in the provision of point 2.3.

2.2 Creating and using an Account on the Service is free of charge. The agreement that is the basis for creating an Account may be terminated by the User at any time on the terms specified in the Regulations. Creating and maintaining an Account does not involve the User being obliged to incur any costs.
